I was contacted just the other day by Pure Essence Labs, whose FemCreme we have proudly carried since its introduction a few years ago.
They are considering discontinuing the product?
Why?
A few of you may be familiar wiith California's Proposition 65, known as the Bounty Hunter's law. A law group (ironically enough, a Women's law group), has filed a suit against many small manufacturers of natural estrogen and progesterone creams, claiming violation of the Safe Drinking Water & Toxic Enforcement act.
They have also filed to have them declared unapproved drugs.
Most small companies do not have the resources to fight this kind of action.
At the same time, action is being contemplated against compounding pharmacies based on a complaint to the FDA by Wyeth ( the largest manufacturer of synthetic hormones) claiming that many compounding pharmacies are making "unsubstantiated marketing claims" that are confusing women about the risks and benefits of natural hormones. To defend themselves, a group of compounding pharmacies has filed a lawsuit -- seeking protection from FDA regulations because pharmacies are regulated by state laws
Unless there is significant consumer outcry, I do not doubt that this is the beginning of the end for natural hormones.
